Trump said on Wednesday that it was "another attack by a very sick and deranged person" while extending his "thoughts, condolences and prayers" to the victims.

Trump's first comment came around midnight, a few hours after prosecutors filed federal terrorism charges against Saipov, a 29-year-old immigrant from Uzbekistan. He also said there is "something appropriate" about keeping him in NY.

Amnesty International USA said it would be a "grave mistake" to send Saipov to Guantanamo.

The diversity program, signed into law in 1990 by Republican President George H.W. Bush, was created to provide more permanent resident visas to people from countries with low United States immigration rates.

Mr Schumer also responded to Mr Trump's criticism by blasting the President for polticising the NY attack.

The law enforcement official said Kadirov was a friend of Saipov's and may not have a role in the case at all, but authorities got suspicious because he "went off the radar" when they went to speak with him.

Trump made the sentencing suggestion in a tweet that also claimed Saipov was "happy" about killing 8 people by driving a truck down a Manhattan bike path Tuesday.

The Federal Bureau of Investigation said it had located another Uzbek man, Mukhammadzoir Kadirov, 32, wanted for questioning as a person of interest in the attack.

The attack was the deadliest in New York City since September 11, 2001, when suicide hijackers crashed two jetliners into the World Trade Center, killing more than 2,600 people.
