Mother of teen slain in 1975 convinced Skakel is the killer

Skakel was accused of bludgeoning Martha Moxley to dying in 1975 in Greenwich, Conn., whereas the pair have been youngsters. He was sentenced to 20 years to life in prison, but was freed on $1.2 million bail after serving 11 years behind bars when the lower court overturned his murder conviction in 2013.

Skakel's current attorney, Hubert J. Santos, said during a brief phone interview that his client was "elated" with Friday's ruling.

Lenski, " A Season In Purgatory" is a dramatic account that follows the case of Harrison Burns, an attractive man who knows a horrifying secret: A young teen was murdered one night long ago, and the person responsible is a family friend from a prominent, political family.

This time - with a new justice on the bench - the court found Skakel's trial attorney failed to investigate a key alibi defense which amounted to a "constitutionally inexcusable" error that "undermines confidence in the reliability" of what was already a "far from overwhelming" conviction.

The court ruled 4-3 that Skakel is entitled to a new trial because of ineffective assistance by his trial lawyer, report the Hartford Courant, the Associated Press and the New York Times.

A spokesman for the CT chief state's attorney's office, which argued against Skakel's appeal in court, said the office was reviewing the decision.

Prosecutors can choose to retry Skakel, according to the decision, but the defense would now have the benefit of that alibi testimony.

The alibi witness, Denis Ossorio, was dating the cousin's sister, and Ossorio says he watched part of the television show with Skakel and others.

The Connecticut Supreme Court has vacated Kennedy cousin Michael Skakel's murder conviction and ordered a new trial in connection with a 1975 killing in wealthy Greenwich.

Connecticut's Division of Criminal Justice did not immediately respond to an email request for comment.

Moxley's mother, Dorthy, told CNN on Friday that she didn't expect the decision. "I just don't think she has the strength to go on with this", he said. "I'm willing to do whatever the state of CT wants me to do". She said the majority had allowed Skakel "to use a motion for reconsideration to judge shop and to obtain an unprecedented second bite at the apple". "This has been going on for half my life".

"We were expecting the decision today", Kennedy said. "I suspect the State is working overtime to look for new forensic evidence in the Skakel matter", he concluded.

Murder conviction of Kennedy cousin Michael... In 1998, former Los Angeles police detective Mark Fuhrman, known for his role in the O.J. Simpson murder case, wrote a book implicating Skakel.
