On Friday, the New York Times revealed that Cohen had made a recording of a conversation with Trump in 2016 in which they had discussed paying former Playboy model Karen McDougal, who claimed she had an affair with Trump ten years before, after the birth of Trump's youngest son, Barron, whose mother is Trump's third wife, First Lady Melania Trump. "It was already out there, so no point in objecting except on principle", said Rudy Giuliani, Trump's personal attorney.

NY law allows one party to a conversation to tape it without the other knowing.

Federal prosecutors in NY have been investigating whether Cohen's actions, including a payment to adult film star Stormy Daniels, violated campaign-finance laws as part of a wide-ranging corruption probe into the longtime Trump fixer. But she said her opinion changed this year when she learned new details about the deal, including that her attorney at the time and AMI had both been in contact with Cohen while her deal was being negotiated.

"So not only is suggesting that Cohen committed a crime in recording him, but to accuse his former lawyer, who simply said may have the goods on him of committing the crime is a awful, bad idea", Specter continued. Trump told Cohen to write a check if a payment was to be made, therefore creating a paper trail; and no payment was made in the end, Giuliani said.

The source close to Cohen says that message was meant to send a clear message about the President's fitness for the job.

Team Cohen remains surprised that Trump's lawyers removed the protective claim of privilege, given their view that the tape is harmful to the President.

The New York Times first reported the existence of the recording. Mr. Trump tweeted a day after the raid.

Current Trump attorney Rudy Giuliani said the payment was never made and the brief recording shows Trump did nothing wrong.

The White House has said that Mr Trump denies having an affair with Ms McDougal and that he has denied having sex with Stormy Daniels.

Giuliani said the conversation involved reimbursing the parent company of the National Enquirer tabloid for McDougal's story rights.

The FBI raided Cohen's home and office on a referral from special counsel Robert Mueller, who is looking into Russian interference in the 2016 election and whether the Trump campaign colluded with Moscow.

But Bash noted on air that Cohen apparently recorded his calls not just with Trump but with "people around the president" and other "significant individuals". "Any attempt at spin cannot change what is on the tape".

On Friday evening, shortly after the news broke, Trump tried to reignite a controversy he had previously stoked over NFL players kneeling in protest during the national anthem. It could also further entangle the president in a criminal investigation that for months has targeted Cohen.

When The Wall Street Journal reported on AMI's payments to McDougal days before the election, the Trump campaign denied knowing about them.

But Giuliani's claims that the tape does Trump no damage was disputed by a source close to Cohen who said that Giuliani is "trying to say what is bad is good".
