Spacey in court charged with sex assault on teenager

The judge granted a request by Spacey's lawyers to preserve the victim's mobile phone data for the six months after the alleged assault.

The two-time Oscar victor - for his supporting role in Usual Suspects in 1996 and his lead role in American Beauty in 2000 - told the judge in a letter that he intends to plead not guilty. A follow-on hearing was scheduled for March 4, but Spacey is not required to attend.

He had previously tried to get out of traveling to the city to appear in court, with his lawyers filing a request that he be allowed to enter his plea without being physically present due to concern that his appearance would "amplify the negative publicity already generated in connection with the case".

A judge denied Spacey's bid to avoid appearing in person on Monday.

But Spacey's lawyer attempted to use the delayed allegations against the victim, claiming his failure to report the assault immediately damages his credibility.

The 59-year-old Oscar-winning actor was charged last month with one count of felony indecent assault and battery.

The accuser's mother told reporters in November 2017 that Spacey got her son drunk and then grabbed his genitals. Prosecutors say they have video of the alleged assault, which occurred at the Club Car Restaurant on Nantucket.

At a probable cause hearing in Nantucket County Court on December 20, Spacey's attorney said the accuser's story had inconsistencies and even acted out the incident to illustrate his point, according to audio of the hearing, which was first published by The Boston Globe.

He nodded in court when the judge told him he was not allowed to contact the victim.

Mexican actor Roberto Cavazos, who performed in several Old Vic productions, said it seemed that "it only took a male under 30 to make Mr Spacey feel free to touch us". He said he left the establishment when Spacey went to the bathroom.

Later, as the two stood near the piano player in the bar, Spacey reached over and began to rub the busboy's thigh, the complaint states. The teen said he tried to shift his body away from Spacey and move Spacey's hands away, but Spacey continued reaching down his trousers. "Spacey stuck his hand inside my son's trousers and grabbed his genitals", Unruh said. He said the woman told him to leave, so he did.
